BOOKING AND CANCELLATION POLICIES

Registration Policy

Registration for retreats, teachings and other events are accepted online, by phone or in person. For security reasons, we do not accept registration by email. You will, however, receive email confirmation of your registration. We process registrations in the order in which we receive them.

For most multiday programs, registration can be secured with a 50% deposit. The balance is due 14 days before the program starts; if it has not been paid, we will automatically charge your credit card.  

Waitlist Policy

We maintain waitlists for all overnight event tickets that have been sold out, offering places to people in the order in which we receive their requests. 

Cancellation Policy

If you need to cancel a reservation, please contact us as soon as possible.

For programs and personal, solitary and winter retreats, we charge a $50 processing fee for all cancellations. This fee funds our program scholarships.

If you cancel within two weeks of a reservation, a nonrefundable credit (less the $50 processing fee) will be held for one year from the date of issue.

We are sorry there are no refunds for afternoon programs.

PHOTO RELEASE

I grant Dharmakaya the right to use photographs and/or video of me in print and electronic communications and promotional materials related to the mission of Dharmakaya.

PRIVACY POLICY

Dharmakaya Center for Wellbeing (DCW) knows that you care how information about you is used and shared, and we appreciate your trust that we will do so carefully and sensibly. This notice describes our privacy policy. By utilizing DCW’s website, you are accepting the practices described in this Privacy Notice.

Personal Information

The information we receive from you helps us personalize and continually improve your DCW experience. Here are the types of information we gather.

• Information You Give Us: We receive and store any information you enter on our websites or give us in any other way. You can choose not to provide certain information, but then you might not be able to take advantage of many of our features. We use the information that you provide for such purposes as improving our customer service and communicating with you.
• Automatic Information: We receive and store certain types of information whenever you interact with us via temporary cookies. Cookies are pieces of information that a website sends to your computer while you are viewing the website. These pieces of information allow the website to remember important information that will make your use of the website more useful. The visitor can alter web browser settings to turn off cookies or allow the computer to display a warning each time a cookie is being received.
• Information from Other Sources: We might receive information about you from other sources and add it to our account information.

Security

• Secure Sockets Layer: To protect the security of your information while you are visiting the DCW website, Secure Sockets Layer (SSL) software encrypts the personal identifiable information you input.
• Third-Party Websites: We may sometimes include links to other websites. We do not provide any personally identifiable customer information to these third-party websites. DCW has no control over the privacy practices of sites outside our domain. If you follow a link to another website, please read that site's privacy policy.  

Credit Card Transactions

• Secure Sockets Layer: To protect the security of your information while you are visiting the DCW website, Secure Sockets Layer (SSL) software encrypts the personal identifiable information you input.
• Minors: Minors (anyone under the age of 18) are not eligible to pay for DCW services and we ask that minors do not submit credit card information. DCW is not responsible for a minor's use of their parent's credit card.
• Incorrect or Fraudulent Information: A credit card transaction may be canceled by DCW if we reasonably determine that the order information you provided is incorrect or fraudulent, or if we reasonably believe the credit card utilized is from an unauthorized party.

Your Email Options

If you do not wish to receive promotional emails from DCW, please click “unsubscribe” at the bottom of any promotional email you receive from us.

DCW will still contact you regarding customer service, program registration, housing, transportation and other related issues.

Privacy Policy Changes

This Privacy Notice and Privacy Policy was posted on August 1, 2019. Dharmakaya Center for Wellbeing reserves the right to change this Privacy Notice and Privacy Policy without notice.

RELEASE, WAIVER OF LIABILITY & ASSUMPTION OF RISK AGREEMENT

I am entering into this Agreement on behalf of myself, and my heirs, assigns and legal representatives, as a condition of my participation in a retreat, program or visit at the Dharmakaya Center for Wellbeing (“DCW”).

I confirm that my participation in a retreat, program or visit is wholly voluntary. In consideration of being allowed to participate, I hereby agree as follows:

1. I have read the Conduct and Etiquette guidelines on DCW’s website and agree to behave accordingly. I understand that:

• Alcohol, non-prescription drugs, cigarettes, meat and fish are not permitted.
• Children must be supervised at all times by a parent or designated guardian.
• Pets, including emotional support animals, cannot be accommodated.
• Open flame, fire and pyrotechnics are prohibited at all times anywhere on DCW premises unless expressly agreed upon in advance.

2. I shall be liable for all damages to the DCW property facility resulting from my either negligent or willful acts or omissions.
3. I am aware that while I am at DCW certain inherent risks are present, including, but not limited to: the remoteness of the location; the unavailability of public transportation; potentially insufficient available healthcare; the hazards of hiking, camping and pursuing other activities in the woods and countryside; the presence of wild animals; the forces of nature; and the possibility of accidents, illness, injury or other damages.
4. I have concluded that the risks of participation in a retreat, program or visit are acceptable to me and are outweighed by a desire to participate in a retreat, program or visit.
5. I agree to use good personal judgment and exercise caution in any potentially risky situation while I am on the campus or under the aegis of DCW.
6. I understand that it is not the function of DCW, the Dharmakaya Organization, or any of their Rinpoches, lamas, teachers, directors, officers, employees, representatives or agents, predecessors, successors and assigns (collectively “Dharmakaya”) to serve as guardians of my physical or mental health or safety, or of my personal property, while I am on the campus or otherwise under their aegis.
7. Accordingly, I understand and agree that Dharmakaya provides no assurance and assumes no responsibility or liability in whole or in part for
   • arrangements for health care or insurance
   • travel to and from the Center
   • arrangements to safeguard myself and my belongings in connection with my participation in a retreat, program or visit
8. I voluntarily and knowingly assume any and all risk of personal injury, death, illness, damaged or stolen property, or other injuries or damages, known and unknown, arising out of, or in connection with my participation in a retreat, program or visit.
9. I agree to hold Dharmakaya harmless for any personal injury, death, damaged or stolen property, or other injuries or damages, known or unknown (including the failure to render first aid, medical treatment or other treatment or service) arising out of, or in connection with my participation in a retreat, program or visit and I voluntarily, knowingly, expressly and forever waive and release any claims, actions, or causes of action for these risks, and for any and all of the other risks that could arise out of or occur during my participation in a retreat, program or visit.
10. I understand that this release, waiver of liability and assumption of risk expressly includes the assumption of any claims, actions, or causes of action for personal injury, death, damaged or stolen property, or other injuries or damages alleged to result from or to arise out of any negligence by Dharmakaya, expressly including, without limitation, negligent supervision, negligent infliction of emotional or mental distress, or premises liability.
11. I agree that I, and not Dharmakaya, shall be fully responsible for payment of any bills for medical services rendered to me as a result of any accidents, injuries, illness or other medical condition arising during, or in connection with my participation in a retreat, program or visit.
12. I agree to indemnify and hold Dharmakaya harmless for all costs, damages and awards, including attorneys’ fees, arising out of any demands, claims (including counter and cross claims), causes of action brought by any other person or entity against Dharmakaya pertaining to, arising out of or as a result of any act or omission by me, whether intentional, negligent or otherwise, in connection with a retreat, program or visit.
13. Should any controversy or claim arise under this Agreement, I agree to submit the dispute or claim to binding arbitration subject to the commercial arbitration rules of the American Arbitration Association. I further agree that any such controversy or claim shall be submitted to one arbitrator selected from the panels of arbitrators of the American Arbitration Association, that I will faithfully observe this agreement and the Rules, that I will abide by and perform any award rendered by the arbitrator, and that a judgment of any court having jurisdiction may be entered on the award.
14. I agree that the provisions of this Release, Waiver of Liability and Assumption of Risk are severable. If any part of this agreement is found to be unenforceable, the other provisions shall remain fully valid and enforceable.

I have carefully read the complete Terms and Conditions and fully understand its contents. I am aware that this agreement is a contract between myself and Dharmakaya Center for Wellbeing. I hereby assume, knowingly and voluntarily, each of the risks referenced in this Agreement, and all of the other risks that could arise out of or occur during my participation in a Retreat, Program or Visit. Checking the box next to “I accept the Terms and Conditions” or simply accepting a reservation serves in lieu of my signature and indicates my agreement to these Terms and Conditions.
